Trade News: New AD/CVD Petition Filed Against Certain Corrosion Resistant Steel Products from Australia, Brazil, Canada, Mexico, Netherlands, South Africa, Taiwan, Turkey, the United Arab Emirates, and Vietnam | Customs & International Trade Law Blog


A gaggle of metal firms and stakeholders filed a petition for the imposition of antidumping and countervailing (AD/CVD) duties on the imports of sure corrosion resistant metal merchandise (“CORE”) from Australia, Brazil, Canada, Mexico, Netherlands, South Africa, Taiwan, Turkey, the United Arab Emirates, and Vietnam. 

Petitioners embody: Metal Dynamics, Inc.; Nucor Company; United States Metal Company; Wheeling-Nippon Metal, Inc.; and the United Metal, Paper and Forestry, Rubber, Manufacturing, Power, Allied Industrial and Service Staff Worldwide Union.

Petitioners allege that these unfairly traded imports have materially injured the U.S. home trade and threaten to trigger additional materials harm if remedial motion will not be taken

Background on AD/CVD Investigations

Antidumping obligation (“AD”) and countervailing obligation (“CVD”) investigations are introduced collectively by the U.S. Worldwide Commerce Fee (“USITC”) and the U.S. Division of Commerce (“Commerce”). AD investigations are triggered when a home trade alleges that it has been injured by competing imports of explicit items from particular nations being offered at lower than a good worth. In the meantime, CVD investigations are triggered when a home trade alleges that it has been injured by competing imports which might be being unfairly sponsored by their governments. 

Scope of the Investigation

This investigation pertains to sure corrosion resistant metal merchandise. The merchandise lined embody sure flat-rolled metal merchandise, both clad, plated, or coated with corrosion-resistant metals reminiscent of zinc, aluminum, or zinc-, aluminum-, nickel- or iron-based alloys.

Subsequent Steps

The Commerce Division will decide whether or not to provoke the investigations inside 20 days. The USITC will attain a preliminary dedication of fabric harm or risk of fabric harm inside 45 days.

As with all continuing, participation is essential to guard your rights. We urge anybody who imports CORE to pay shut consideration to this case and to make sure that all applicable steps are taken to mitigate any injury.

AD/CVD investigations can lead to determinations adversarial to respondent pursuits for years that would successfully prohibit entry to the U.S. market. Failure to successfully take part in investigations can put exporters and importers at a major drawback.
