The Jammu & Kashmir Excessive Courtroom directed the UT administration to evict unauthorised occupants of presidency lodging, citing lack of authorized entitlement.
This order stems from a 2020 Public Curiosity Litigation (PIL) filed by Prof. S.Okay. Bhalla.
The PIL focused unauthorised occupation of presidency lodging by former ministers and politicians.
Regardless of earlier orders, occupants remained, prompting the courtroom’s current directive.
The Division Bench of Chief Justice Tashi Rabstan and Justice M A Chowdhary directed:-
-Evict unauthorised occupants.
-Get well industrial rental prices.
-File newest standing report by December 12, 2024.
-Commissioner/Secretary, Estates Division, to seem in individual.
The Estates division recognized 33 unauthorized occupants, recommending eviction and discretionary quota allotment. 4 occupants vacated, whereas others had been requested to comply with swimsuit.
The courtroom expressed concern over the Estates division’s inaction, citing sluggish progress since 2020.
It questioned why eviction orders weren’t issued post-elections and why industrial rental prices weren’t levied.
