USTR Announces Section 301 Investigation into Nicaragua’s Acts, Policies, and Practices Related to Labor Rights, Human Rights, and the Rule of Law | Customs & International Trade Law Blog


The USA Commerce Consultant (USTR) introduced the investigation relating to Nicaragua’s acts, insurance policies, and practices associated to labor rights, human rights, and the rule of legislation below Part 301 of the Commerce Act of 1974. That is the primary 301 investigation involving insurance policies and practices that will violate labor rights and human rights.

301 Background

Part 301 of the Commerce Act of 1974 is designed to handle unfair overseas practices affecting U.S. commerce. It grants USTR a variety of authorities to analyze unfair commerce practices and to implement U.S. rights below commerce agreements.

Below 301, the U.S. authorities could impose commerce sanctions on overseas nations that have interaction in acts which can be burdensome to U.S. commerce or that violate commerce agreements.

The legislation doesn’t restrict the scope of investigations, however it does point out a number of classes of actions which can be topic to 301 motion, together with:

(1) a violation that denies U.S. rights below a commerce settlement

(2) an “unjustifiable” motion that “burdens or restricts” U.S. commerce

(3) an “unreasonable” or “discriminatory” motion that “burdens or restricts” U.S. commerce.

Nicaragua Investigation

Politically-motivated arrests and imprisonments
Repression of members of spiritual teams and non-governmental organizations
Extrajudicial killings

Restrictions on freedom of expression and motion

Repression of freedom of affiliation and collective bargaining
Pressured labor, human trafficking, eliminating legislative and judicial independence
Spurious seizures of property, arbitrary fines and rulings, and different dangerous acts

In accordance with USTR, the Authorities of Nicaragua has not responded to issues raised by america or others. The said aim of the investigation is to handle and resolve these issues to make sure U.S. firms and employees are handled pretty and with equal respect below a rule of legislation system.
