US government seeks to deport Kilmar Ábrego García to Liberia

The US authorities plans to deport Kilmar Ábrego García to Liberia as quickly as Oct. 31, in accordance with a Friday court docket submitting by the Division of Homeland Safety (DHS), regardless of a collection of federal court docket rebukes over his wrongful deportation case.

A Salvadoran nationwide who has resided in Maryland for greater than a decade, Ábrego García’s case drew nationwide consideration when he was mistakenly deported to El Salvador earlier this 12 months regardless of a court docket discovering that he confronted a “well-founded worry” of persecution there. After that elimination, the US Supreme Courtroom required the federal government to “facilitate” his return, and he was repatriated in June 2025.

As a result of Ábrego García is barred from returning to El Salvador, US officers say they’ve sought different nations—Uganda, Eswatini, Ghana, and now Liberia—which have agreed to take him on a “strictly humanitarian and short-term foundation.” Such deportations can be a part of the federal authorities’s broader push to hold out third-country removals.

Ábrego García’s attorneys countered that deporting him to a rustic with which he has no connection, removed from his US-based household, is punitive, merciless, and unconstitutional.

In March, Ábrego García and his household filed a lawsuit within the US District Courtroom for the District of Maryland, alleging that Ábrego García’s deportation violated his constitutional rights and former court docket orders. Decide Paula Xinis dominated that the deportation “shocks the conscience” and that “there have been no authorized grounds in anyway for his arrest, detention, or elimination.”

When federal officers later requested a keep, the US Courtroom of Appeals for the Fourth Circuit denied the movement. The panel said in its determination that “[t]he United States Authorities has no authorized authority to grab an individual who’s lawfully current in america off the road and take away him from the nation with out due course of.”

In the meantime, Ábrego García faces federal human-smuggling expenses in Tennessee, which US District Decide Waverly Crenshaw dominated carried a “real looking probability” of vindictive prosecution by the federal authorities.
