New AD/CVD Case Filed Against Polypropylene Corrugated Boxes from Vietnam and China | Customs & International Trade Law Blog


A brand new antidumping and countervailing obligation motion has been filed towards “Polypropylene Corrugated Containers” imported from Vietnam and China. These containers are colloquially know as Vegetable or Seafood Containers and are used to pack and ship articles resembling produce. The allegation is that imports from China are each unfairly backed and are being dumped (bought beneath value) whereas imports from Vietnam are alleged to being dumped (bought for beneath value).

Background on AD/CVD Investigations

Antidumping obligation (“AD”) and countervailing obligation (“CVD”) investigations are introduced collectively by the U.S. Worldwide Commerce Fee (“USITC”) and the U.S. Division of Commerce (“Commerce”). AD investigations are triggered when a home trade alleges that it has been injured by competing imports of explicit items from particular international locations being bought at lower than a good worth. In the meantime, CVD investigations are triggered when a home trade alleges that it has been injured by competing imports which are being unfairly backed by their governments. The home trade initiating the investigation is called the petitioner whereas the international trade taking part within the investigation is called the respondent.

Scope of the Investigation

The merchandise coated by these investigations is Polypropylene Corrugated Containers (“PCBs”). PCBs are containers, totes, or different containers made of corrugated polypropylene sheets, additionally identified as polypropylene hole core sheets, polypropylene twin wall sheets, or multi wall sheets.

The merchandise topic to the investigations are presently categorised in the Harmonized Tariff Schedule of the United States (HTSUS) below statistical reporting quantity 3923.10.9000.

Subsequent Steps

The Commerce Division will decide whether or not to provoke the investigations inside 20 days. The USITC will attain a preliminary willpower of fabric damage or risk of fabric damage inside 45 days.
