New AD/CVD Case Filed Against Van-Type Trailers and Subassemblies Thereof From Canada, Mexico, and China | Customs & International Trade Law Blog


A brand new antidumping and countervailing obligation motion has been filed in opposition to Van-Kind Trailers and Subassemblies Thereof From Canada, Mexico, and the Individuals’s Republic of China (China). The allegation is that imports from Canada, Mexico, and China are unfairly backed and being dumped.

Background on AD/CVD Investigations 

Antidumping obligation (“AD”) and countervailing obligation (“CVD”) investigations are introduced collectively by the U.S. Worldwide Commerce Fee (“USITC”) and the U.S. Division of Commerce (“Commerce”). AD investigations are triggered when a home trade alleges that it has been injured by competing imports of specific items from particular nations being bought at lower than a good worth. In the meantime, CVD investigations are triggered when a home trade alleges that it has been injured by competing imports which might be being unfairly backed by their governments. The home trade initiating the investigation is named the petitioner, whereas the overseas trade taking part within the investigation is named the respondent. 

Scope of the Investigation 

The merchandise lined by these investigations is van-type trailers and subassemblies thereof, whether or not completed or unfinished.  

The merchandise topic to the investigation are at the moment categorized within the Harmonized Tariff Schedule of america (HTSUS) beneath the next subheadings: 8716.39.0040, 8716.90.5060, 7308.30.5050, 7308.90.9590, 7326.90.8688, 8708.29.1500, 9708.99.8180, and 8716.90.5010.

Subsequent Steps 

The Commerce Division will decide whether or not to provoke the investigations inside 20 days. The USITC will attain a preliminary dedication of fabric harm or risk of fabric harm inside 45 days.  

As with all continuing, participation is essential to guard your rights. We urge anybody who imports van-type trailers and subassemblies thereof to pay shut consideration to this case and to make sure that all applicable steps are taken to mitigate any injury. 

AD/CVD investigations may end up in determinations opposed to respondent pursuits for years that might successfully prohibit entry to the U.S. market. Failure to successfully take part in investigations can put exporters and importers at a big drawback.
