New AD/CVD Case Filed Against Certain Fatty Acids From Indonesia and Malaysia   | Customs & International Trade Law Blog


A brand new antidumping and countervailing responsibility motion has been filed towards sure fatty acids from Indonesia and Malaysia. The allegation is that imports from Indonesia and Malaysia are unfairly sponsored and are being dumped.

Background on AD/CVD Investigations

Antidumping responsibility (“AD”) and countervailing responsibility (“CVD”) investigations are introduced collectively by the U.S. Worldwide Commerce Fee (“USITC”) and the U.S. Division of Commerce (“Commerce”). AD investigations are triggered when a home business alleges that it has been injured by competing imports of specific items from particular nations being bought at lower than a good worth. In the meantime, CVD investigations are triggered when a home business alleges that it has been injured by competing imports which are being unfairly sponsored by their governments. The home business initiating the investigation is named the petitioner, whereas the overseas business taking part within the investigation is named the respondent.

Scope of the Investigation

The merchandise coated by these investigations is for certain fatty acids, that are natural acids made from a hydrocarbon chain with a carboxylic acid group hooked up to an R-group, with an iodine worth beneath 105g/100g and with a ratio of free fatty acids to triglycerides of a minimum of 97%.

The merchandise topic to the investigation are presently labeled within the Harmonized Tariff Schedule of america (HTSUS) beneath the next subheadings: 2915.70.01.20, 2915.70.01.50, 2915.90.10.50, 2916.15.10.00, 2916.15.51.00, 3823.11.00.00, 3823.12.00.00, 3823.19.20.00, 3823.19.40.00, 2915.70.01.10, and 2915.90.10.10.

Subsequent Steps

The Commerce Division will decide whether or not to provoke the investigations inside 20 days. The USITC will attain a preliminary dedication of fabric damage or menace of fabric damage inside 45 days.

As with every continuing, participation is essential to guard your rights. We urge anybody who imports fatty acids from Indonesia and Malaysia to pay shut consideration to this case and to make sure that all acceptable steps are taken to mitigate any injury.
