AD/CVD News: Initiation of AD/CVD Investigations on Silicon Metal from Angola, Australia, Laos, Norway, and Thailand  | Customs & International Trade Law Blog


On April 24, 2025, Ferroglobe USA, Inc. and Mississippi Silicon LLC (collectively, “Petitioners”) filed an antidumping and countervailing duties petition on ferrosilicon from Angola, Australia, Laos, Norway, and Thailand.

Background on AD/CVD Investigations

Antidumping responsibility (“AD”) and countervailing responsibility (“CVD”) investigations are introduced collectively by the U.S. Worldwide Commerce Fee (“USITC”) and the U.S. Division of Commerce (“Commerce”). AD investigations are triggered when a home business alleges that it has been injured by competing imports of explicit items from particular international locations being bought at lower than a good worth. In the meantime, CVD investigations are triggered when a home business alleges that it has been injured by competing imports which are being unfairly sponsored by their governments. The home business initiating the investigation is named the petitioner whereas the international business collaborating within the investigation is named the respondent.

Scope of the Investigation

The merchandise lined is all types and sizes of silicon steel, together with silicon steel powder. Silicon steel comprises not less than 85.00 % however lower than 99.99 % silicon, and fewer than 4.00 % iron, by precise weight. Semiconductor grade silicon (merchandise containing not less than 99.99 % silicon by precise weight and classifiable underneath Harmonized Tariff Schedule of the USA (HTSUS) subheading 2804.61.0000) is excluded from the scope of this investigation.  

Silicon steel is at the moment classifiable underneath subheadings 2804.69.1000 and 2804.69.5000 of the HTSUS. Whereas the HTSUS numbers are supplied for comfort and customs functions, the written description of the scope stays dispositive. 

Subsequent Steps

On Could 21, 2025, the U.S. Division of Commerce (“Commerce”) initiated each the antidumping and countervailing duties investigations. The interval of investigation for the antidumping investigation is April 1, 2024, to March 31, 2025. The interval of investigation for the countervailing duties investigation is January 1, 2024, to December 31, 2024.  

The preliminary willpower for the antidumping investigation is scheduled to be printed on October 8, 2025 (could also be prolonged by Commerce till November 27, 2025). The preliminary willpower for the countervailing duties investigation is scheduled to be printed on July 25, 2025 (could also be prolonged by Commerce till September 28, 2025).  

As with every continuing, participation is essential to guard your rights. We urge anybody who imports ferrosilicon to pay shut consideration to this case and to make sure that all acceptable steps are taken to mitigate any injury.

AD/CVD investigations may end up in determinations hostile to respondent pursuits for years that would successfully prohibit entry to the U.S. market. Failure to successfully take part in investigations can put exporters and importers at a big drawback.
