PM Modi educational degree row: Supreme Court dismisses Arvind Kejriwal plea – India Legal


The Supreme Courtroom on Monday refused to entertain a petition filed by former Delhi Chief Minister Arvind Kejriwal in opposition to a prison defamation case filed by the Gujarat College Registrar over his controversial remarks concerning the tutorial diploma of Prime Minister Narendra Modi.

The Bench of Justice Hrishikesh Roy and Justice SVN Bhatti famous that in April 2024, the Apex Courtroom had dismissed an analogous petition filed by co-accused Sanjay Singh difficult the identical order of the Gujarat Excessive Courtroom.

Taking in view the Apex Courtroom order of April 2024, the Bench mentioned it was not inclined to entertain Kejriwal’s plea. It clarified that every one contentions have been left open to be determined within the trial and that it has not gone into the deserves of the matter.

Showing for Kejriwal, Senior Advocate Dr Abhishek Manu Singhvi submitted that he merely requested why the College was not publishing Modi’s diploma and puzzled if it was as a result of the diploma was pretend.

The Senior Counsel mentioned that if in any respect the assertion was defamatory, it was for the Prime Minister to file a prison defamation case and never for the Gujarat College Registrar.

Representing the College, Solicitor Common Tushar Mehta drew the eye of the Courtroom to the order handed in Sanjay Singh’s case.

Singhvi responded that Singh’s statements have been totally different and sought to tell apart Kejriwal’s case.

The SG additional apprised the Courtroom in regards to the Gujarat Excessive Courtroom’s order quashing the course of the Central Data Fee to furnish a duplicate of Modi’s diploma certificates.

The Excessive Courtroom had handed strictures in opposition to Kejriwal in that judgment and imposed prices on him, added the SG.

Senior Advocate Singhvi argued that the entire intention behind the case was to disqualify Kejriwal from political life by securing a conviction within the defamation case.

He requested the Courtroom to grant Kejriwal a chance to file an announcement of remorse and a chart exhibiting how his statements have been totally different from Sanjay Singh.

The Apex Courtroom noticed that it may permit Singhvi to argue, however cautioned that after the arguments have been heard, the petitioner wouldn’t be allowed to withdraw the matter and a call on deserves can be rendered.

Singhvi finally conceded and the matter was dismissed in view of the order handed in Sanjay Singh’s case, with out going into the deserves.
