Professor Tu has supplied the next summary of his speak:

Summary: China’s latest adoption of the Regulation of the Individuals’s Republic of China on Overseas State Immunity marks a significant shift from the precept of absolute state immunity to that of restrictive state immunity. Largely motivated by the will to align extra carefully with the norms of the worldwide group, this transfer has raised some basic points within the authorized preparations between the Chinese language Central Writerity and Hong Kong and Macau, its two particular administrative areas (SAR), that are administered underneath the ‘One Nation, Two Programs’ formulation. Earlier than the adoption of the Chinese language Overseas State Immunity Regulation (CFSIL), the precept of absolute immunity, which was utilized in Mainland China, was launched into the SARs by way of a lawsuit in Hong Kong. With the adoption of the brand new regulation, numerous questions have arisen concerning its implementation in Hong Kong and Macau and the authorized preparations between the Chinese language Central Authority and the 2 SARs.
